Summary

PB 2024 nr. 41 is the consolidated Curaçao National Ordinance on the combating of money laundering, the financing of terrorism, and the financing of proliferation. It establishes the overarching AML/CFT/CPF statutory framework for Curaçao, implementing FATF Recommendations and integrating virtual asset service providers into the AML/CFT/CPF regime effective May 16, 2024.

This ordinance is the primary consolidated AML/CFT/CPF statute that amended both the Landsverordening melding ongebruikelijke transacties (NORUT/MOT, PB 2017 nr. 99) and the Landsverordening identificatie bij dienstverlening (NOIS/LID, PB 2017 nr. 92). It introduced proliferation-financing concepts, expanded the MOT service perimeter to include VASPs, added sanctions-match reporting obligations, granted FIU transaction-suspension powers, and revised registration, supervision, and enforcement provisions for service providers including VASPs.

The Memorie van Toelichting (No. 3 explanatory memorandum) provides legislative intent and interpretation guidance for the ordinance.
